We have very upsetting news about Kesha’s case against Dr. Luke

Two months after Judge Shirley Werner Kornreich denied Kesha’s request to be released from her recording contract with her producer Dr. Luke, Kesha’s case against Sony has now been thrown out. This recent development is terrible news for Kesha, who has been fighting to escape her recording contract, cut all ties to her alleged abuser and go back to making music for her fans.

In March, Kesha’s lawyers filed an appeal against the decision, stating, “Although (the court) recognized that ‘slavery was done away with a long time ago’ and that ‘(y)ou can’t force someone to work … in a situation in which they don’t want to work,’ the Court’s ruling requiring Kesha to work for Gottwald’s companies, purportedly without his involvement, does just that.”

According to TMZ, the judge rejected Kesha’s “slavery” argument and sided with the recording company. “Although [Luke’s] alleged actions were directed to Kesha, who is female, [her claims] do no allege that [Luke] harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha,” Judge Kornreich was quoted as saying.

Just a few days ago, Kesha posted a photo of herself on Instagram saying she was given the offer of “freedom” if she agreed to lie. “I would have to APOLOGIZE publicly and say that I never got raped,” the caption read. “THIS IS WHAT HAPPENS behind closed doors. I will not take back the TRUTH. I would rather let the truth ruin my career than lie for a monster ever again.”

Kesha’s claims that Dr. Luke violated her rights by sexually abusing her cannot go forward because they happened outside of New York and are beyond legal time limits, reports AP. In response to Kesha’s claims of intentional infliction of emotional distress, the judge ruled that “insults about her value as an artist, her looks, and her weight are insufficient to constitute extreme, outrageous conduct intolerable in civilized society.”

Judge Kornreich ended the ruling by saying, “Every rape is not a gender-motivated hate crime.”
